Sales and Shipping Conditions Offers are subject to confirmation. If an ordered wine is sold out, we reserve the right – after consulting you – to supply a wine that is equivalent in terms of price and flavour. Old price lists lose their validity once a new price list appears. The prices in € cover delivery from our Piesport wine cellar and include glass, casing, packaging, VAT and tax on sparkling wine. Breakages must be reported immediately and confirmed by the freight operator on the original shipment note. Storage We accept no liability for the consequences of improper storage. Therefore, please store the wine laid down in a cool and dark room. We retain ownership over the delivered wines until full payment of all owed amounts. Shipment Type We ship your order to your door via the parcel service of the Deutsche Post AG (German Post). Orders for largish quantities are delivered by freight (prices upon request). Terms of Payment/Payment Processing We ask first-time customers to transfer the invoiced amount in advance, or to arrange for it to be paid by direct debit, into our account. We deliver subsequent orders against invoice or per direct debit, as you wish. Invoices must be paid within 30 days of the date on the invoice. Please note: payment by credit card is not yet possible. Place of Fulfilment Place of fulfilment for delivery and performance is Piesport/Mosel. Place of jurisdiction is 54470 Bernkastel-Kues for both parties. It is therefore necessary for the consignee to have the shipper immediately confirm the damage at the time of handover and to inform us straightaway. Complaints Any complaints must be reported at the latest within 14 days of receipt of the goods. Deposits of tartaric acid crystals in the wine are a natural phenomenon and do not affect the wine’s quality. Thus, they do not constitute grounds for complaint. A replacement consignment can be demanded only if the defective goods have been returned. No deficiency-related rights exist if the deterioration in quality is due to improper handling or storage by the customer. The wine must be stored in a cool and dark place. Components, Complaints about Deficiencies Transport-related damage (e.g. glass breakage) must be reported immediately, but at the latest 7 days after receipt. Other complaints about any type of deficiencies must, if they are apparent, be reported immediately, and likewise at the latest 7 days after receipt. Hidden deficiencies must be reported immediately after being discovered. Deposits of tartaric acid crystals are due to natural maturation; thus, they do not constitute a deficiency and therefore cannot be the subject of a complaint. Data Protection and Security The information you supply enjoys data protection – and in connection with your order, in particular under the Teleservices Data Protection Act (Teledienstedatenschutzgesetz, TDDSG) and the Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG). Your data and details are not disclosed to third parties. In order to process and execute your order we pass on your data to the shipping service commissioned to undertake the shipment. We use your information exclusively for proper processing of your order. By placing your order you agree to our General Business and Delivery Conditions. Cancellation Briefing Right of Cancellation You may cancel your contract agreement in writing (e.g. letter, fax, email) within 14 days without giving reasons, or – if the merchandise has been delivered before such deadline has expired – by returning the goods. The said period commences upon receipt of this briefing in written form, but not before receipt of the goods by the consignee (for recurrent deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfilment of our obligation to provide information under §312c para. 2 of the Civil Code (Bürgerliches Gesetzbuch, BGB) in conjunction with §1 paras. 1, 2 and 4 of the Civil Code-Information Obligations Regulation (BGB-Informationspflichten-Verordnung, BGB-InfoV) and also of our obligations under §312e para. 1, clause 1 of the BGB in conjunction with §3 of the BGB-InfoV. The cancellation period is met if the cancellation notice or the merchandise was dispatched prior to the deadline. Consequences of Cancellation In the event of a valid cancellation, the services received by both parties are to be returned and, if applicable, any benefits derived (e.g. interest) refunded. If you are not able to return the service received in full or in part, or only in a deteriorated condition, you must, where appropriate, compensate us for the value. This does not apply to returnable articles if the deterioration of the item can be attributed exclusively to inspection of the item – such as may occur in a retail outlet. You can avoid the obligation to pay compensation for deterioration caused through regular use of the item for the purpose for which it is intended by not using the item as your property and refraining from actions which diminish the value of the item. Items suitable for dispatch by parcel are to be sent back at our risk. You must pay the costs for the return if the delivered goods comply with the ordered goods and if the price of the goods returned does not exceed €40 or if, in the event of a higher price, you have not yet paid the agreed consideration or the contractually agreed part-payment. Otherwise the return is free of charge for you. Items not suitable for dispatch by parcel will be collected from you. Payment obligations must be honoured within 30 days. Such period begins (a) for you once your notice of cancellation has been sent or the item dispatched, and (b) for us upon receipt thereof.
